Terms of Service — The PM Toolkit

1. Acceptance of Terms

By accessing or using The PM Toolkit ("Service"), operated at thepmtoolkit.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Description of Service

The PM Toolkit is an AI-powered product management platform that helps product managers, founders, and startup teams generate structured deliverables including market research, competitive analysis, strategy documents, user stories, financial models, and executive outputs.

The Service uses third-party artificial intelligence APIs — including providers such as Anthropic and OpenAI — to generate content based on user inputs and project context. By using the Service, you acknowledge that your inputs are processed by these third-party AI providers in accordance with their respective data use policies.

3. Account Registration

To use the Service, you must create an account using email and password authentication, or sign in through Google OAuth. You are responsible for:

Maintaining the confidentiality and security of your account credentials
All activities that occur under your account
Ensuring your account information remains accurate and up to date
Notifying us immediately of any unauthorized use of your account at [email protected]

We reserve the right to suspend or terminate accounts that show signs of unauthorized access or misuse.

4. Subscription Plans and Billing

4.1 Plan Availability

The PM Toolkit offers multiple subscription tiers including a free tier and one or more paid tiers. Current plan details, features, token allocations, project limits, and pricing are described at thepmtoolkit.app/pricing, which is incorporated into these Terms by reference.

Feature availability and plan limits are subject to change. We will provide reasonable advance notice of material changes to paid plan features. Your continued use of the Service after such notice constitutes acceptance of the updated plan terms.

4.2 Billing and Payment

Paid subscriptions are billed on a recurring monthly basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Cancellation

You may cancel your subscription at any time through the billing portal accessible within your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period ends.

4.4 Refunds

Subscription fees are generally non-refundable for partial billing periods. Exceptions may be made at our discretion in cases of documented technical failure of the Service, or where required by applicable consumer protection law in your jurisdiction. 4.5 Plan Changes

You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of the current billing period.

5. AI-Generated Content

Content generated by the Service is produced by artificial intelligence and is provided "as-is." The following terms apply to all AI-generated content:

AI-generated content may contain errors, inaccuracies, outdated information, or incomplete analysis
You are solely responsible for reviewing, validating, fact-checking, and making decisions based on any AI-generated content
The PM Toolkit does not guarantee the accuracy, completeness, fitness for purpose, or suitability of AI-generated content for any business, legal, financial, or other decision
AI-generated content should not be relied upon as a substitute for professional legal, financial, strategic, or other expert advice

We strive to improve output quality continuously, but the inherent limitations of AI systems mean that no output can be guaranteed to be error-free.

6. Data Privacy and Security

6.1 Data Isolation

All project data, research inputs, and generated content are isolated to your individual account. Your data is not accessible to other users of the Service and is not shared across accounts.

6.2 AI Training

Your project inputs and generated content are not used to train AI models. We use the Anthropic and OpenAI APIs under terms that do not permit your data to be used for model training by those providers. We do not sell, license, or otherwise transfer your project data to third parties for training or commercial purposes.

6.3 Data Retention and Deletion

You may delete individual projects at any time from within your account. Deleted projects and all associated artifacts are permanently removed from our active systems. No recoverable copies are retained after deletion is confirmed.

Upon full account deletion, all associated project data, generated artifacts, and profile information are permanently deleted within 30 days. To request account deletion, contact [email protected].

6.4 Security Practices

We implement industry-standard security practices including encryption of data in transit (TLS) and at rest, database-level access controls, and account authentication via secure session tokens. A full description of our security practices is available at thepmtoolkit.app/privacy.

7. Intellectual Property

7.1 Your Content

You retain full ownership of all content you input into the Service, including project names, descriptions, context, and any other materials you provide. You also own the AI-generated content produced by the Service based on your inputs, subject to any applicable terms of the underlying AI providers.

7.2 Our Intellectual Property

The PM Toolkit retains all rights to the Service itself, including its design, codebase, features, branding, and underlying infrastructure. Nothing in these Terms transfers any ownership of the Service or its components to you.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service. We are not obligated to compensate you for feedback.

8. Acceptable Use

By using the Service, you agree not to:

Use the Service for any unlawful purpose or to generate harmful, misleading, defamatory, or fraudulent content
Attempt to reverse-engineer, decompile, disassemble, or extract the source code of the Service
Circumvent, disable, or attempt to bypass usage limits, rate limits, access controls, or authentication mechanisms
Share your account credentials with others or allow unauthorized third-party access to your account
Use automated scripts, bots, crawlers, or scraping tools to access or extract data from the Service
Resell, redistribute, white-label, or sublicense the Service or its outputs without prior written consent
Upload or input content that infringes third-party intellectual property, privacy, or other rights
Attempt to access another user's data, account, or content

Violations of this section may result in immediate account suspension or termination without refund.

9. Usage Limits

Each subscription plan includes defined limits on the number of projects, AI-generated content, and other features as described on the pricing page. These limits are designed to ensure fair access across all users.

If you reach your plan's usage limits, you will receive a notification within the Service. You may continue using other features of the Service until your usage resets at the start of your next billing period, or you may upgrade your plan to continue generating AI content immediately.

We reserve the right to implement reasonable usage controls or modify plan limits with advance notice to prevent abuse or ensure service reliability for all users.

10. Third-Party Services

The Service integrates with third-party providers to deliver its features, including but not limited to:

Anthropic and OpenAI — AI content generation
Supabase — database and authentication infrastructure
Stripe — payment processing
Resend — transactional email delivery
Serper — web search for research features

Your use of the Service is also subject to the applicable terms and privacy policies of these third-party providers. We are not responsible for the practices, availability, or content of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, The PM Toolkit and its operators shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or reputational harm, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any and all claims arising from or related to these Terms or your use of the Service shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

The Service will be uninterrupted, error-free, or free from bugs or vulnerabilities
AI-generated content will be accurate, complete, current, or suitable for your specific needs
The Service will meet your specific business requirements
Any errors or defects in the Service will be corrected within any specific timeframe

13. Termination

13.1 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms, suspected fraudulent or abusive behavior, or non-payment of applicable fees. We will endeavor to provide notice where reasonably practicable.

13.2 Termination by You

You may terminate your account at any time by canceling your subscription through the billing portal and contacting us at [email protected] to request account deletion.

13.3 Effect of Termination

Upon termination, your right to access and use the Service ceases immediately. Your project data and generated content will be permanently deleted within 30 days of account termination in accordance with Section 6.3. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and dispute resolution — shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. The nature of the change determines how we communicate it:

Material changes affecting your rights or obligations: communicated via email and in-app notification at least 14 days before taking effect
Minor or clarifying changes: updated on this page with a revised "Last updated" date

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as mutually agreed.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
